GDPR

For people in the European Economic Area, the United Kingdom and Switzerland: what the GDPR gives you, how DeskTick handles data under it, and how to use your rights. It adds to the privacy policy and does not replace it.

01Controller and processor

For your account and your developer profile, LoudOwls is the controller: we decide why and how that data is handled.

For data inside a company's workspace, that company is the controller and we are its processor: we handle the data on its instructions. The data processing agreement page sets out the terms of that.

02Why we are allowed to handle your data

  • To perform our agreement with you: running your account, your profile, the record of your work, and hiring you take part in.
  • With your consent: listing your profile in the directory, showing your email or phone on it, storing an identity document, and connecting accounts such as GitHub. You can withdraw consent at any time, in the product.
  • For our legitimate interests: keeping the service secure, preventing abuse, and improving it — never in a way that overrides your rights.
  • To comply with the law: billing and tax records, and requests we are legally bound to answer.

03Your rights

  • Access: ask what we hold about you and get a copy.
  • Rectification: correct what is wrong. Most of it you can change yourself, from your profile.
  • Erasure: delete your account, with the 60-day window described in the privacy policy.
  • Restriction and objection: ask us to stop or limit a use of your data.
  • Portability: receive what you gave us in a form you can take elsewhere.
  • Withdraw consent, where we rely on it.
  • Not to be subject to a decision made by a machine alone that seriously affects you. We make none.

To use any of these, write to [email protected] from the address on your account. We answer within one month.

04The record of your work, and erasure

One limit is worth stating plainly. The hours and dates of an engagement are also the company's record of work done for it, and a hiring conversation has two sides. When your account is erased those remain with the company, attributed to a deleted account with your name removed. Your profile, documents, bank details, connected accounts and email address are erased.

While you have an account, the recorded figures cannot be edited by anyone. If you believe one is wrong, tell us and we will look at how it was recorded.

05Data leaving Europe

LoudOwls is based in India, and our providers run servers outside the EEA and the UK, including in the United States. Where your data is transferred to a country that has not been found to give equivalent protection, we rely on the safeguards the GDPR provides for that, such as standard contractual clauses with the provider.

The privacy policy lists the providers.

06How long

As the privacy policy sets out: for as long as you have an account, 60 days after you ask to delete it, and longer only for billing records and the record a company holds of work done with it.

07Complaints

Tell us first at [email protected] and we will try to put it right. You also have the right to complain to the data protection authority where you live or work.
